ORDER

This writ petition has been filed for issue of writ of mandamus directing the 2 nd and 3 rd respondents to dispatch the police verification report to the 1 st respondent in order to enable the 1 st respondent to process the application submitted by the petitioner on 01.04.2025, wherein, the petitioner is seeking for issuance of passport.

2.When the matter was taken up for hearing today, the learned Government Advocate appearing on behalf of the 2 nd and 3 rd respondents

3/6 submitted that FIR was registered in Crime No.90 of 2021 and that the investigation is pending.

3.The learned Central Government Standing Counsel appearing on behalf of the 1 st respondent submitted that the petitioner did not inform about the pending case in Crime No.90 of 2021 and hence, a notice was issued to the petitioner on 29.07.2025, to provide his explanation with supporting documents. 4.This Court has carefully considered the submissions made on either side and the materials available on record.

5.In the considered view of this Court, the mere registration of the FIR in Crime No.90 of 2021 by the 3rd respondent, where the investigation is pending, cannot be considered to be a "Case Pending" against the petitioner. The law on this issue is now too well settled.

6.In view of the above, there shall be a direction to the 1st respondent to process the application submitted by the petitioner on 01.04.2025 and issue the

4/6 passport, if the petitioner has satisfied all the other requirements. This process shall be completed, within a period of four weeks from the date of receipt of copy of this order.
