ORDER

This petition has been filed to condone the delay of 478 days in preferring the second appeal against the judgement and decree dated 21.12.2020 made in A.S No. 31 of 2019 by the Subordinate Court, Namakkal.

2. The learned counsel for the petitioner submits that on account of Covid pandemic there was a lack of communication between the petitioner and his counsel, so the petitioner was not able to file the appeal on time. Hence, he filed this petition.

3. Considering the facts and circumstances, the reason assigned by the petitioner is satisfactory. Further, the petitioner are senior citizens, in order to avoid multiplicity of proceedings, this court is inclined to allow this petition on condition that the petitioners shall pay a cost of Rs.3,000/- to the respondents' counsel within a period of two weeks from the date of receipt of a copy of this order. Post on 19.03.2025.
