Prayer: Writ Petition is filed under Article 226 of the Constitution of India for issue of Writ of Mandamus, directing the respondents to pay interim on the belated payment of terminal benefits namely commutation of pension amount and CRBS amount to the petitioner at the rate of 6 percent per annum, for the period from the date of retirement (31.01.2018) to till the date of actual disbursement within a time limit.

The Writ Petition is filed for the following relief: "directing the respondents to pay interest on the belated payment of terminal benefits namely commutation of pension amount and CRBS amount to the petitioner at the rate of 6 percent per annum, for the period from the 2/6

date of retirement (31.01.2018) to till the date of actual disbursement within a time limit".

2. It is an admitted fact that the petitioner, who had joined the services of the respondent-Corporation, had retired from service on 31.01.2018. Though the petitioner had retired on 31.01.2018, the retirement benefits had been deposited into his account after a lapse of nearly 1 year from the date of his retirement. Therefore, the petitioner had claimed interest @ 6% towards the belated payment of terminal benefits. However, the respondents have not taken any steps whatsoever to consider the petitioner's representation dated 22.08.2022. The fact that the payments have been made with a delay has not been controverted by the respondents.

3. Heard the learned counsels on the either side and perused the materials available on record.

4. Considering the above facts and circumstances of the case, a 3/6

mandamus is issued to the respondents to pay interest @ 6% for the belated payment of the retirement benefits from the date of retirement till the date of actual disbursal of the terminal benefits of the petitioner, within a period of six weeks from the from the date of receipt of a copy of this order. The interest is fixed at 6% taking into account the prevailing interest rate for fixed deposits.
