O R D E R

The petitioner, who was arrested and remanded to judicial custody on 29.07.2025, for the offence punishable under Sections 77, 78 and 79 of BNS, Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act and Section 66(E), 67 and 67A of the Information Technology Act, in Crime 1/6

No.11 of 2025, registered on the file of the respondent, seeks bail.

2. The case of the prosecution is that, on the complaint given by Madelein Shirley, a case was registered on 28.07.2025 by the respondent police in Crime No.11 of 2025.

3. According to the complaint, the defacto complainant had an affair with A1, a married man. Later, A1 allegedly took the help of A2, who resides opposite of the complainant's house, to secretly take photographs of A1 and use them to intimidate the complainant. It is further alleged that A1 shared the footage, secretly taken by A2, with third parties. It is also alleged that there was an attempt to illegally access her phone data, including call details, location, contacts, and private chats. Based on the complaint, the petitioner herein was arrested on 29.07.2025.

4. The learned counsel appearing for the petitioner submits that the petitioner has nothing to do with the personal dispute between the defacto complainant and A1. He is a professional detective and his services were sought by A1 for sharing certain photographs. The petitioner is ready to cooperate with the investigation, however, he has been in judicial custody for 2/6

15 days without any fault on his part.

5. The learned counsel further submits that the police have already taken custody of the petitioner and conducted a search of his office premises, but nothing incriminating was recovered.

6. The learned counsel states that the petitioner is innocent and has been falsely implicated in this case. He further submits that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for the grant of bail to the petitioner.

7. Accordingly, the petitioner is ordered to be released on bail on depositing a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) in the account pertaining to Crime No.11 of 2025 within a period of fifteen days. On such deposit, the surety may be considered and on further conditions that:

[a] The petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Metropolitan Magistrate, Additional Mahila Court, Egmore, 3/6

Chennai.

[b] The sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;

[c] The petitioner shall report before the respondent police as and when required for interrogation.

[d] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];

[e] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
