PRAYER : Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, to direct the respondents police to provide the police protection to the petitioner.

ORDER

From the petition, it appears that when the petitioner was engaged in constructing house in her plot, some unknown persons have demolished the Page No.1/4

compound wall. When the same was reported to the respondent police, they, instead of giving her protection, had instructed her not to continue with such construction.

2. When this Court enquired whether any complaint regarding rival claim over the property received by the police, or given to the police, or any suit is pending, the learned counsel appearing for the petitioner submitted that there is no suit or rival claim over the title, in any manner. If it is so, the police is bound to take action against the persons who have demolished the construction, and have been identified in the photographs annexed with the complaint.

3. The Criminal original petition is allowed with a direction to the respondent police to take action on the complaint and if there is any recurrence of the event, appropriate protection should be provided. 06.10.2023 Internet : Yes/No Index : Yes/No msr Page No.2/4
