ORDER

This Criminal Original Petition has been filed to transfer the investigation in Crime No.75 of 2021 pending on the file of the respondent police to the CBCID police or any other investigation agency.

2. The case of the petitioner is that his jewels have been stolen from his house on 10.04.2021 and immediately he had given a complaint before the respondent police. On the basis of the complaint given by the petitioner, a case in Crime No.75 of 2021 for the offences under sections 454, 457 and 380 of IPC has been registered. However, even after four years, investigation has not been completed and the accused has not been secured. Hence, seeks to transfer the investigation from the respondent police to CBCID or any other investigating agency.

3. The learned Government Advocate [Criminal Side] on instructions submitted that investigation has been done and as the accused has not been

identified, the accused could not be secured and the case has been closed as undetected.

4. As the investigation has been substantially progressed and the accused could not be identified, at this stage transfer of investigation will not serve any purpose. Since all the materials and finger prints have been collected and also been verified with the habitual offenders. The same did not match. Therefore, the respondent has closed the case as undetected. In such view of the matter, the police shall continue to match the finger prints with any other new accused and if the finger prints match, the case can be reopened and prosecution can be continued.

5. With the above observation, this Criminal Original Petition is closed. 14-08-2025
