This Criminal Miscellaneous Petition has been preferred to suspend the sentence and fine imposed on the petitioner by the Special Court for POCSO Cases, Thiruvannamalai in Spl.S.C.No.135 of 2019 dated 22.09.2022 and enlarge the petitioner on bail, pending disposal of the above Criminal Appeal.
2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent police and perused the materials available on record.
3. The petitioner has been found guilty for the offence under Section 5(m) of POCSO Act punishable under Section 6 of POCSO Act. Since the offence is against a child who is aged about 5 years and not completed the age of 12 years, this Court is inclined to take up the main appeal itself ''for final disposal'' soon after receipt of the entire records, and hence, this Criminal Miscellaneous Petition is dismissed. 4.The Registry is directed to call for the records from the Court below and prepare typed set of papers and serve copies on the learned counsel on either side well in advance.
5. List the Criminal Appeal after the typed set of papers are made ready.
