O R D E R

This Contempt Petition has been filed for punishing the respondent for having disobeyed the orders of this Court dated 26.04.2024 in W.P.No.11377 of 2024.

2. The order under contempt is in respect of the direction issued by the Writ Court for considering the representation of the petitioner in connection with disbursement of the compensation amount for acquisition of the land in S.F.No.316/2D. The petitioner had already instituted a suit in O.S.No.38 of 2024 on the file of the Sub Court, Pallacode. Before the Writ Court, a statement was made by the learned Special Government Pleader that the compensation amount would be deposited to the credit of the suit.

3. Now, the Contempt Petition has been filed on the ground that the amount has not been deposited so far as undertaken.

4. Today, learned Special Government Pleader stated before this Court that without verification of records, the learned counsel for the petitioner built castles in the air, as the entire compensation amount had already been paid to one Kuppusamy, who is none other than the Uncle of the petitioner. He further stated that in fact the petitioner had given no objection for payment of the amount to the said Kuppusamy. Learned Special Government Pleader has also produced the written instructions dated 2/4

06.12.2024 of the Special District Revenue Officer (LA), Krishnagiri before this Court in support thereof.

5. At this juncture, learned counsel for the petitioner submitted that the petitioner was a minor at that time and signature has been obtained by her uncle.

6. Be that as it may, the amount had already been disbursed from the Government side. As the suit is already pending for partition, the petitioner can very well recover her share of compensation in the final suit by making appropriate amendment in the suit.

7. Finding that no contempt has been made out by the respondent, this Contempt Petition is closed. No costs. 06.12.2024 ar 3/4
