Prayer : Writ Petition (Criminal) filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the respondents to disburse to the petitioner's family, a sum of Rs.6,37,500/- being remainder of the total enhanced relief amount of Rs.8,25,000/- as per Annexure-1, Serial Number 45 and provide Government Employment to the petitioner as per Annexure-1, Serial Number 46 of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Amendment Rules, 2016 within a time frame fixed by this Court.

ORDER

This Writ Petition (Criminal) has been filed seeking a direction to the respondents to disburse the petitioner's family a sum of Rs.6,37,500/-, being the balance amount out of the total enhancement relief amount of Rs.8,25,000/- as per Annexure-1, Serial Number 45 and to provide Government employment to the petitioner as per Annexure - 1, Serial Number 46 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Rules, 2016. 2.

Heard the learned counsel appearing on either side and perused the materials available on record.

The petitioner is the sister of the deceased. The petitioner's brother was murdered by the accused, pursuant to which an FIR was registered in Crime No.328 of 2012. Therefore, the deceased's family was granted compensation under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Rules 1995, to the tune of Rs.2,50,000/-. Accordingly, the petitioner's father was paid a sum of Rs.1,87,500/- on 20.12.2012 towards 75%. That apart, the petitioner's mother was assigned land to an extent of 0.81.0 hectares in Survey No.8/4 of Dhurinjikollai Village, Chidambaram Taluk, Cuddalore District by an assignment order dated 22.01.2013. However, not being satisfied with the same, the deceased's family made further representation and a Peace Committee Meeting was convened, wherein the petitioner's family was assured to consider their case for Government Employment and also assessment of some land. As per the assurance, the petitioner's family was assigned with some land. 4.

Insofar as the government employment is concerned, the Rules does not provide to grant any employment to the deceased's family. Further, the petitioner, being the sister of the deceased, has sought enhancement compensation as per the Amended Rule 12(4) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Rules 1995, which came into effect on 14.04.2016. The said amendment does not apply to the petitioner since the incident had occurred prior to 14.04.2016. Accordingly, the persons who were affected by atrocities before 14.04.2016 are not entitled to claim enhanced

compensation, Government employment, agricultural land or house sites under the amended provisions.

Accordingly, the petitioner's family had already been granted compensation and also land was assigned in favour of the petitioner's mother. Therefore, there is no provision to provide Government employment to the petitioner's family members. Further, the petitioner's family is not entitled to enhanced compensation under the amended Rules which came into force on 14.04.2016. However, the petitioner's family is entitled to receive the remaining 25% of the compensation out of Rs.2,50,000/-. 6.

In view of the above, the third respondent is directed to disburse the remaining 25% of the compensation amount out of Rs.2,50,000/- within a period of four weeks from the date of receipt of a copy of this order. 7.

With the above direction, this Writ Petition (Criminal) stands disposed of. No costs.
