ORDER

(Order of the Court was made by the Hon'ble Chief Justice) When the petition was called out in the pre-lunch session, Mr.Prabhakar, learned State Government Pleader, requested the matter to be passed over to enable him to get instructions.

2. Post lunch, Mr.Prabhakar, on instructions from respondent No.2, stated that the representation of the petitioner will be acted upon by conducting necessary survey and if any encroachment is found, action will be taken after following the principles of natural justice and due process. Mr.Prabakar states that action will be taken within six weeks from today.

3. In view of the statement made by Mr.Prabakar, on instructions from respondent No.2, which we take as an undertaking from respondent no.2 to this court, petition stands disposed of.

4. We clarify that we have not made any observation on the merits of the matter.

5. There will be no order as to costs.
