Respondent Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, directing the DRT-2, Coimbatore to dispose of S.A.No.534 of 2021 filed by the petitioner herein, within a reasonable time frame.

ORDER

(Made by the Hon'ble Chief Justice) Heard Mr.Anirudh A Sriram, learned counsel for the petitioner and Mr.B.Raghavalu Naidu, learned counsel for the respondent.

2. The writ petition is filed seeking a direction to decide the S.A.No.534 of 2021, pending before the Debts Recovery Tribunal - II, Coimbatore.

3. This Court had granted interim relief in favour of the petitioner on 02.11.2022, considering the bonafides shown by the petitioner that he is ready to present the demand draft for the entire outstanding amount. The petitioner did not deposit the amount. On 31.07.2023, we adjourned the matter for two weeks, enabling the petitioner to deposit the amount.

4. Today also, learned counsel for the petitioner submits that the petitioner is unable to deposit the amount.

5. The matter is already pending before Debts Recovery

Tribunal - II, Coimbatore. The petitioner may file an application before the Debts Recovery Tribunal for expeditious disposal of the Securitization Application and the application, if filed by the petitioner, shall be decided by the Tribunal on its own merits.

6. In view of that, the writ petition stands disposed of. There will be no order as to costs. Consequently, W.M.P.Nos.28387 & 28388 of 2022 are closed.
