Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to dispose of the representation dated 14.12.2018 made by the petitioner by refixing the scale of pay of the petitioner who was working as Vocational Instructor at Rs.2000-3500 on par with the scale of pay sanctioned to Mr.Narayanasamy under G.O.Ms.No.327, dated 18.11.2013 and on par with vocational instructors who were in service at the time plus 2 system was introduced in the Schools in the State of Tamil Nadu within the time frame to be fixed by this Court. Writ Petition is filed for issuance of a Writ of Mandamus directing the respondents to dispose of the representation dated 14.12.2018 made by the petitioner by refixing the scale of pay of the petitioner who was working as Vocational Instructor at Rs.2000-3500 on par with the scale of pay sanctioned to
Mr.Narayanasamy under G.O.Ms.No.327, dated 18.11.2013 and on par with vocational instructors who were in service at the time plus 2 system was introduced in the Schools in the State of Tamil Nadu within the time frame to be fixed by this Court.
2. Heard the learned counsel appearing for the petitioner as well as the learned Special Government Pleader appearing for the respondents. By consent, the writ petition is taken up for final disposal.
3. The case of the petitioner is that he joined the Education Department as Part Time Vocational Instructor in the year 1985. Thereafter, the petitioner was regularised in the post of Vocational Instructor with effect from 15.10.1992. The petitioner along with several other similarly placed persons have already sent a representation seeking refixation of pay scale in terms of G.O.Ms.No.327, School Education Department, dated 18.11.2013 on par with one Mr.G.Narayanasamy, who was regularised at the same time as the petitioner and however, the said representation was rejected. The petitioner retired on 31.10.2018. The petitioner has again made a representation dated 14.12.2018 to the respondents. However, the said representation was not considered by the respondents till date. Hence, this writ petition.
4. Learned counsel appearing for the petitioner submitted that it would suffice, if this Court issues direction to the respondents to consider the petitioner's representation dated 14.12.2018 and pass appropriate orders within the reasonable time.
5. Considering the limited request made by the learned counsel appearing for the petitioner, this Court hereby directs the respondents to consider the petitioner's representation dated 14.12.2018 and pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.
