Respondent Prayer: Civil Revision Petition is filed under Article 227 of the Constitution of India, praying to fix a time to dispose the H.M.O.P.No.4388 of 2016 filed for divorce between the petitioner and respondent, pending on the file of learned VII Addl. ORDER

The Revision Petitioner husband has filed a petition for divorce in H.M.O.P.No. 4388 of 2016 on the ground of cruelty against the respondent/wife. The respondent/wife also appeared and filed her counter. Now, the case is riped for trial and the evidence was also adduced on the side of Revision Petitioner, but she is not cooperating with the trial. Even the Revision Petitioner is ready to meet out the travel expenses, for that she is not cooperating by producing relevant documents like tickets. Due to non-cooperation of respondent wife, the case is still pending without any progress. Therefore, the Revision Petitioner prayed to issue a direction to dispose the case as early as possible.

2. Since the relief claimed by the Revision Petitioner only seeking a direction for a speedy disposal, the notice to the respondent is dispensed with.

3. Considering the facts and circumstances and also the fact that the respondent wife is not cooperating with the trial proceedings, this Court is inclined to direct the trial judge to commence the trial and dispose the case 2/4

as expeditiously as possible within a period of two months from the date of receipt of copy of this order. However, as on date, the Revision Petitioner husband had paid more than Rs.12,00,000/- towards interim maintenance. Hence, the respondent wife is directed to cooperate with the trial proceedings. Liberty granted to her to claim travel expenses with relevant ticket particulars. Accordingly, this Civil Revision Petition is disposed of. No costs.
