This Petition came to be numbered by transfer of ORA.SR.No.136/2018/TM/CHN from the file of the Intellectual Property Appellate Board, Chennai to cancel/delete/expunge the entries in the Trademark Registration No.3654426 in Class 41, as regards the trade description of services by removing the words Simplified Physical Exercises, Kayakalpa Yoga, Simplified Kundalini Yoga, Panchenthiryam, 1/4

Nithiyanandham, Nine Centre, Mirror Gazing, Irainilai, Panchabootha Navagraga Mediations & Vethathirian Principles / Philosophy in the discretion of services of the said trademark registration. ORDER

The learned counsel for the applicant presented a Joint Memorandum of Compromise entered into between the applicant and the 1st respondent dated 29.07.2024 and it is signed by the applicant and the 1st respondent and also their respective learned counsel.

2.The parties are also present and they affirmed the execution of the Joint Compromise Memorandum.

3.The said memo dated 29.07.2024 is taken on file. 4.Recording the said memo, the Original Petition is disposed of in 2/4

terms of the Joint Compromise Memo. The said Joint Compromise Memo shall form part of the order.

5.In view of the Joint Memorandum of Compromise, the 2nd respondent shall pass positive orders, in the light of the compromise arrived at the parties, within a period of eight (8) weeks from the date of receipt of the copy of this order.
