B. Pandurangan Respondents Writ Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus directing the second respondent Executive Engineer, Zone 6, Chennai Corporation, to take expeditious steps to remove the encroachment made by Pandurangan (sixth respondent) in front of the petitioner's property in Somaiya Street and also direct the fourth respondent-Inspector of Police, K-5, Peravallur Police Station, to provide adequate police protection for the officials to carry out the inspection and removal of encroachment.

ORDER

After some arguments, Mr. Velmurugan Parthiban, learned counsel on record for writ petitioners, sought leave of this Court to withdraw the captioned main 'writ petition' [hereinafter 'WP' for the sake of brevity] and captioned 'writ miscellaneous petition' [hereinafter 'WMP' for the sake of brevity] thereat. Learned counsel 2/4
had to make such a request as survey number in which there is alleged encroachment (to be noted, captioned main WP is for removal of encroachment) has not been mentioned either in the captioned main WP or in the writ affidavit. Learned counsel sought leave of this Court to preserve all the rights and contentions of writ petitioner to come back to this Court with writ petition mentioning the survey number(s) with clarity and specificity. Scanned reproduction of the endorsement made in the case file as follows: Request acceded to.
Captioned main WP and captioned WMP thereat are disposed of as withdrawn/closed, albeit with preservation of rights of writ petitioner in the aforesaid manner. There shall be no order as to costs.
