ORDER

While disposing of the main Writ Petition in W.P.No.18694 of 2022 dated 30.01.2024, I had directed the respondents to extend all the service benefits to the petitioner with effect from 06.08.2021 including any notional promotions which may have been

deprived to her. Alleging disobedience, the petitioner had filed a Contempt Petition in Cont.P.No.1110 of 2024.

2.When the above contempt petition was taken up hearing on 12.07.2024, it was reported by the Special Government Pleader that the order of the writ court has been complied with, since all the service benefits have been extended to the petitioner. However, in so far as the notional promotion with effect from 06.08.2021 is concerned, he had reported that the petitioner would be ineligible for any promotion. The learned counsel for the petitioner at that juncture had objected to such a statement and submitted that the petitioner was eligible to be promoted to the post of Associate Professor. In the background of these disputed facts, I had granted liberty to the petitioner to work out her remedies for seeking notional promotion. 3.

In the present sub application, the petitioner seeks for modification of the original order, in so far as it observes that the petitioner would be ineligible for any promotion. The petitioner places reliance on the proceedings of the 1st respondent herein dated 04.12.2024, wherein, the revised pay scale statement of the petitioner has been annexed. As per the said statement, the petitioner's designation for the purpose of fixation of pay is shown as Associate Professor, Department of Home Science, and the pay band is derived as Rs.37,400/- Rs.67,000/- + Academic Grade Pay at Rs.9,000/-. 4.

Effectively, it requires to be construed that the petitioner has indeed been promoted to the post of an Associate Professor. 5.Now, that the petitioner's designation has been advanced under the Career Advancement Scheme, and the pay scale has also been appropriately revised, the petitioner may not have any further grievance. As such no modification is required to the said order passed in Cont.P.No.1110 of 2024 dated 12.07.2024. Since, I had clarified the original order passed in Cont.
