O R D E R

This Criminal Original Petition has been filed to quash the proceedings in C.C.No.74 of 2015 on the file of the Judicial Magistrate, Additional Mahila Court, Coimbatore District. 2.The accused are charged for the offences under Sections 498-A, 406 and 506(ii) IPC. The petitioners herein are A2 and A3, who are the parents-in-law of the de facto complainant/wife.

3.When the matter was taken up for hearing today, the learned counsel appearing for the present petitioners submitted that the proceedings as against A1/husband has already been quashed by this Court by order dated 11.11.2021 made in Crl.O.P.No.21572 of 2017, mainly on the ground that, divorce was granted by mutual consent and there was a compromise between the husband and wife to withdraw the proceedings pending before the Mahila Court. The learned counsel has produced a copy of the aforesaid order.

4.Taking note of the above fact that the proceedings as against A1 has already been quashed and divorce has been granted and the matter has been compromised between the husband and wife, continuance of prosecution as against the present petitioners/A2 and A3, who are the parents-in-law of the de facto complainant, will serve no purpose. Therefore, this Court is inclined to quash the criminal proceedings as against the petitioners herein also.

5.Accordingly, this Criminal Original Petition is allowed and as a sequel, the criminal proceedings in C.C.No.74 of 2015 on the file of the Judicial Magistrate, Additional Mahila Court, Coimbatore District, is quashed. Consequently, connected miscellaneous petitions are closed.
