O R D E R

This Criminal Original Petition has been filed seeking to direct learned Judicial Magistrate II, Virudhachalam to recall the non-bailable warrant issued as against the petitioner on 11.8.2023 in P.R.C.No.11 of 2023 on the same day of his surrender.

2. The petitioner is arrayed as the fourth accused in P.R.C.No.11 of 2023 on the file of learned Judicial Magistrate-II, Virudhachalam for the offences punishable under Sections 302, 120B, 449, 307, 109, 176 and 201 of the Indian Penal Code.

3. The petitioner was absent during the trial in P.R.C.No.11 of 2023 on the file of learned Judicial Magistrate-II, Virudhachalam. Therefore, the non bailable warrant came to be issued on 11.8.2023.

4. The learned counsel appearing for the petitioner undertakes that the petitioner will appear before the Court below regularly on all future 2/4

hearing dates without fail.

5. Considering the undertaking given by the petitioner, the petitioner is directed to appear before learned Judicial Magistrate-II, Virudhachalam within a period of two (2) weeks from today and file a petition to recall the the non bailable warrant issued against him. The concerned Magistrate is directed to consider the same on merits and pass orders on the same day.
