This writ petition has been filed seeking issuance of Writ of Certiorarified Mandamus calling for the records relating to the electricity connection No.206/011/1381 dated 05.06.2013 registered on the file of the first respondent with respect to Villa Site No.B-1, Door No.3/620, East Coast Road, Palavakkam, Chennai - 600 041, comprised in Survey No.24/1A (part) and 25/1A (part), New Survey No.24/1A1A1A and 25/1A1A1, Patta bearing no.4552, Palavakkam Village, Sholinganallur Taluk, Chennai District and quash the same, 2/6
and to consequently direct the first respondent to transfer the electricity connection in the name of the Winney s-D Export and Import Private Limited with respect to the said Villa Site No.B-1, Door No.3/620, East Coast Road, Palavakkam, Chennai - 600 041, comprised in Survey No.24/1A (part) and 25/1A (part), New Survey No.24/1A1A1A and 25/1A1A1, Patta bearing no.4552, Palavakkam Village, Sholinganallur Taluk, Chennai District. 2.The learned counsel appearing for the petitioner submitted that the petitioner is 30% minority shareholder of Winney's-D Export and Import Private Limited, a company formerly registered with the second respondent under the provisions of Companies Act, 1956. The Company was struck off under Section 248 of the Companies Act, 2013 on 14.02.
2022, however, the former Directors of the Company executed a fraudulent sale deed vide document no.2783/2024 dated 23.03.2024 selling the immovable properties of the struck off Company in favour of the fourth respondent. On the basis of the said transaction, the fourth respondent approached the Electricity Board and mutated the electricity service connection and challenging the same, the petitioner has filed this writ petition.
3.The learned counsel appearing for the petitioner further submitted that challenging the sale deed in document no.2783/2024 dated 23.03.2024, the petitioner has filed W.P.No.29383 of 2025 and the same is pending. Hence, this Court may without going into the merits of the writ petition, dispose of this writ petition by observing that the transfer of the electricity service connection, in respect of the subject property, in favour of the fourth respondent, is subject to the result of the writ petition in W.P.No.29383 of 2025. 4.Recording the submission of the learned counsel appearing for the petitioner, this writ petition is disposed of. The transfer of the electricity service connection, in respect of the subject property, in favour of the fourth respondent, is subject to the result of the writ petition in W.P.No.29383 of 2025. No costs. Consequently, connected miscellaneous petitions are closed.
