ORDER

This Writ Petition is filed for a writ of Mandamus directing the respondents 1 to 3 to consider the petitioner's representation dated 10.07.2023 and to an enquiry and cancel the fabricated bogus power of attorney in Doc.No.4342 of 2015 dated 08.06.2015, Sale Deed in Doc.No5494/2015 dated 15.07.2015 in favour of 4th respondent and the mortgage deed in D.No.5525/2015 dated 16.07.2015, executed by 4th respondent, within a stipulated time.

2.Today, when the matter was taken up for hearing, the learned counsel for the petitioner submitted that it would suffice if a direction is issued to the respondents to consider the representation of the petitioner.

3. The learned Special Government Pleader takes notice for the respondents 1 to 3 and he admits that the representation dated 10.07.2023, made by the petitioner was received. However, so far no order has been passed.

4. In the light of the limited scope of prayer sought for in this writ 2/5

petition and the submissions of the learned counsel on either side, this Court without going into the merits of the case, directs the 2nd respondent to consider the petitioner's representation dated 10.07.2023 after issuing notice to the 4th respondent herein and also to the interested parties and rival claims if any, and conduct enquiry in the manner known to law and pass appropriate orders on merits and in accordance with law as expeditiously as possible provided within a period of three months from the date of receipt of copy of this order.

5. With the above directions, the writ petition is disposed of at the admission stage itself. However, there shall be no order as to costs. 06.10.2023 ksa-2 Index : Yes / No Speaking Order : Yes / No 3/5
