Respondent PRAYER :- Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of mandamus directing the respondent to admit the petitioner in the 3 years LLB Degree Course, Admission 2016-2017 pursuant to the Calling Letter dated 16.11.2016 for Fifth Counselling held on 23.11.2016 in the respondent Government Law Colleges either in Trichy or Thirunelveli immediately by considering the petitioner's representation dated 23.11.2016. ORDER

Heard the learned counsel for the petitioner and Mr.L.P.Shanmugasundaram, learned Standing Counsel who accepts

notice on behalf of the respondent and with the consent on either side, the writ petition is taken up for final disposal. The case of the petitioner is that he had completed B.Tech [Information Technology] during the year 2013 and in order to pursue his studies, had applied for three years LLB Course in the respondent / University and he belongs to Backward Class community. It is the further case of the petitioner that the cut off marks was fixed at 68.739 and he had secured 65% and that vide Call Letter dated 16.11.2016, the petitioner was called upon to appear for Counselling to be held on 23.11.2016. On that day, the petitioner was not eligible to be selected on the ground that his cut off mark is 61.9% and that the eligibility criteria was fixed as 65%.

The petitioner's grievance is that the University had adopted the grade system and had arrived at 61.9% as cut off marks in respect of the petitioner herein ; while according to the petitioner, his cut off mark is 65%. Stating all the above facts and his grievances, the petitioner had made a representation dated 23.11.2016 to the respondent herein and since the same was not considered, he is before this Court by filing the present writ petition.

Though the petitioner has prayed for a larger relief, this Court, in the light of the above facts and circumstances and without going into the merits of the claim projected by the petitioner either in this writ petition or in his representation dated 23.11.2016 directs the respondent to consider and dispose of the petitioner's representation dated 23.11.2016 on merits and in accordance with law and pass orders within a period of one week from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner. The writ petition stands disposed of with the above direction. No costs. Consequently, the connected miscellaneous petition is closed.
