PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents to release the lorry bearing Regn.No.TN-32-E-1561, which was seized by the second respondent on 18.11.2016 and thereby consider the representation dated 19.11.2016. Mr.S.Diwakar, learned Special Government Pleader accepts notice for the respondents. Heard both. By consent, the writ petition itself is taken up for final disposal.

2. The petitioner seeks a direction to the respondents to release the lorry, which was seized by the second respondent on the ground that the vehicle was transporting sand illegally.

3. The vehicle is now in the custody of the first respondent. No purpose will be served if the vehicle is exposed to sun and air.

Therefore, without going into the merits of the case of the petitioner, the writ petition is disposed with a direction to the first respondent to consider the representation of the petitioner dated 19.11.2016 on merits and pass orders thereon in accordance with law, within a period of one week from the date of receipt of a copy of this order.
