J U D G M E N T

The present Civil Miscellaneous Appeal has been preferred by the father of the minor seeking to set aside the order dated 20.12.2016 passed in G.O.P.No.222 of 2014 by the Third Additional District Court, Salem, refusing to give custody of the child.

2.Even though the present Civil Miscellaneous Appeal is preferred for a larger relief, the parties have negotiated between themselves and amicably settled the issues. According to the settlement, the appellant/father has settled a piece of immovable property of the mother in favour of the minor daughter by way of a Settlement dated 24.04.2019 bearing Document No.2546/2019.

3.As agreed by the parties, the appellant will restrict his relief in respect of visitation right alone. Accordingly, the respondents agreed that the appellant can visit his minor daughter on 2nd and 4th Sunday between 10.00 am and 05.00 pm at the place of guardians of the minor.

4.The original settlement deed is handed over to the learned counsel for the respondents across the Court. The appellant is entitled to approach this Court for modification of the order.

5.The Civil Miscellaneous Appeal is ordered in the above terms. No costs. Consequently, connected civil miscellaneous petition is closed.
