C.M.P.Nos.23364, 23366 & 23367 of 2019 in A.S.No.608 of 2011 S.M.SUBRAMANIAM.,J These petitions are filed to condone the delay of 2038 days in filing the petition to set aside the abatement; to set aside the abatement caused by the death of the second respondent and to bring on record the legal representatives of the deceased second respondent in the first appeal.

2.This Court is satisfied with the reasons stated in the supporting affidavit. The petition in C.M.P.No.23364 of 2019 to condone the delay of 2038 days in filing the petition to set aside the abatement is ordered and the delay is condoned. The abatement caused due to the death of the second respondent is set aside and C.M.P.No.23366 of 2019 is allowed. Proposed respondents are ordered to be brought on record as legal representatives of the deceased second respondent in the Appeal and the petition in C.M.P.No.23367 of 2019 is allowed.
