This petition is filed to condone the delay of 85 days in filing the above Civil Miscellaneous Appeal against the order in MCOP.No.1667 of 2021 dated 15.12.2022 on the file of the Motor Accidents Claims Tribunal, Special District Judge (FAC), Salem.

2.M/s.I.Malar, learned counsel takes notice for the second respondent.

3.Having satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, this petition stands allowed and the Registry is directed to number the above C.M.A.SR.No.123112 of 2023, if the papers are otherwise in order.

4.In the eventuality of the petitioner succeeding in the appeal, interest may have to be reckoned only from the date on which the Registry takes the appeal on record.
