The application in Arb.Appln.No.524 of 2023 has been filed to recall the warrant of Commission dated 28.06.2023 issued to the learned Advocate Commissioner on the basis of the order dated 28.06.2023 passed by this Court in Arb.A.No.334 of 2023.

2. The application in Arb.Appln.No.525 of 2023 has been filed to set aside the exparte order dated 28.06.2023 passed by this Court in Arb.A.No.334 of 2023.

3. The application in Arb.Appln.No.334 of 2023 has been filed to appoint Advocate Commissioner to visit the respondent premises and to seize and take custody of the applicants' equipment.

4. Both the learned counsel would submit that in the present case, the Corporate Insolvency Resolution Proceedings was initiated vide order dated 22.03.2024 and pursuant to the said order, the Insolvency Page No.1/3

Resolution Professional has been appointed by the National Company Law Tribunal, Chennai. Therefore, they would submit that the parties will file their claims before the Corporate Insolvency Resolution Proceedings and hence, they requests this Court to close these applications.

5. Considering the above submission, this Court is of the view that the parties can approach the Corporate Insolvency Resolution Proceedings for their claims and in such case, it is not necessary to keep this petition pending.

6. In view of the above, this Court is inclined to close these applications. Accordingly, these applications are closed. 08.04.2024 nsa Page No.2/3
