C.M.P.No.20778 of 2022 and SA.SR.No.56315 of 2022 C.V.KARTHIKEYAN,J.

This Application has been filed seeking to condone the delay of 109 days in paying the deficit Court fee of Rs.4855/-. 2.In the affidavit filed in support of the said petition, it had been stated that the Court fee of Rs.175/- affixed in the First Appeal as well as in the Original Suit. Therefore, the same amount was affixed in the Second Appeal. But the Registry had directed that the Tamil Nadu Court Fees and Suit Valuation Act, 1965 had been amended and therefore, the deficit Court fee are required to be paid.

3.In view of the above reasons, this petition is allowed and the delay is condoned. The Registry to number SA.SR.No.56315 of 2022, if it is otherwise in order.
