This petition is filed by the petitioner seeking permission to make appropriate application to the office of the Narcotics Commissioner, 4th respondent herein, for registration of his sales contract for import of poppy seeds from Turkey.

2. The learned Senior Counsel appearing for the petitioner submitted that as against the order passed in the writ petition, writ appeal in W.A.No.251 of 2016 was preferred by the third parties/ impleaded respondents in the writ petition and they have subsequently withdrawn the writ appeal. Reliance has been made on the order passed by the Division Bench of Karnataka High Court in W.A.No.132 of 2016, in which, the writ petitioner/appellant therein was given a period of one week to make an application for registration of import contract for import of poppy seeds, though on the concession given by the Additional Solicitor General. In view of the withdrawal of the appeal in W.A.No.251 of 2016 filed by the impleaded respondents and the liberty granted in the said appeal to the petitioner herein to move the writ Court to make out an application to the 4th respondent herein, the present miscellaneous petition has been filed placing reliance on the order of the High Court of Karnataka in W.A.No.132 of 2016.

3. The learned counsel appearing for the respondents submitted that they will not have any objection to grant time to the petitioner to make an application to the 4th respondent.

4. Considering the submissions made by the learned counsel appearing on either side, the miscellaneous petition is ordered, giving liberty to the petitioner to make an application to the 4th respondent within a period of one week from today (28.03.2016). On receipt of the same, the 4th respondent shall consider the same on merits along with other pending applications.
