This is the second bail petition filed by the accused, who is facing trial for offence under Sections 302 and 449 of the IPC. 1/4

The petitioner was arrested on 24.06.2024 for causing the death of one Dayalan due to previous enmity. It is alleged that he has trespassed into the house of the deceased at midnight and had done to death by cutting him into pieces using a knife.

The learned Government Advocate (Crl.Side) appearing for the State opposed the bail petition, stating that the petitioner is a history-sheeter and due to a property dispute between the family members of the defacto complainant and their relatives, he committed the murder of Dayalan, while he was sleeping inside the house. It was further submitted that the gruesome nature of the murder has caused shock in the minds of public and if the petitioner is released on bail, he would pose a threat to the victim's family. He also submitted that the case is posted on 18.08.2025 for framing of charges and if the accused is released before examination of witnesses, he will threaten them. 4.

This Court, on considering the facts and the submissions made by the learned Government Advocate (Crl.Side), finds no merit in the petition and accordingly dismissed the Criminal Original Petition. 12.08.2025 rpl 2/4
