ORDER

This writ petition has been filed seeking a direction to the 1st Respondent to expeditiously take up and dispose of the appeal filed by the petitioner, registered as E-filing No 3122106 of 2022 05.09.2022.

2. It is the case of the petitioner that in 2015, a chit transaction was registered with the sub chit fund Registrar, Coimbatore, in which, the chit value

was Rs.10,00,000/- carrying an interest rate of 24% The petitioner availed Rs.6,00,000/- from the chit fund and signed the required promissory note but did not receive the remaining Rs.4,00,000/- The petitioner did not receive any summons or notices regarding dispute proceedings initiated before the Sub chit Fund Registrar due to relocation, causing her unawareness and nonparticipation, an Ex-parte order was passed against the petitioner in the absence of her representation. Subsequently, the petitioner received a notice related to recovery proceedings under EP. No.494 of 2021 from the II Additional Subordinate Court, Coimbatore. Challenging the said order, the petitioner filed appeal before the first respondent and submitted her representation on 20.01.2023 emphasizing the urgency of early hearing of the said appeal and the same was not considered. Hence, the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may issue a direction to the first respondent to consider the petitioner's appeal and pass appropriate orders within the stipulated time as fixed by this Court.

4. The learned Special Government Pleader submitted that the petitioner's appeal will be disposed within the stipulated time as fixed by this Court.

5. Heard the learned counsel for the petitioner and the learned Special Government Pleader and perused the materials available on record.

Considering the facts and circumstances of the case and having regard the submissions made by the learned counsel on either side, this Court directs the first respondent to consider the representation of the petitioner and dispose the appeal on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.
