ORDER

This petition has been filed to transfer the investigation pending on the file of the second respondent in Crime No.389 of 2016 to any other competent agency.

2.The learned counsel appearing for the petitioner would submit that the crime is of the year 2016. Though, she lost one eye, the 2nd respondent has not even registered for major offences under Sections 294(b), 324 and 506 part 2 of Indian Penal Code. Now, the petitioner has died nine months back even then she did not get any justice from the 2nd respondent. 3.Mr.K.Prabakar, the learned Additional Public Prosecutor appearing for the 1st respondent submitted that the investigation https://hcservices.ecourts.gov.in/hcservices/

itself completed on 10.10.2017. However, the entire bundle was misplaced in the police station. Now, the 2nd respondent has traced out the bundle and they are about to file a final report. 4.Considering the facts and circumstances of the case, now at this stage, transfer of investigation cannot be considered. However, the 2nd respondent is directed to file final report within a period of four weeks from the date of receipt of a copy of this order after considering the injury sustained by the petitioner herein and major offences if any attracted as against the accused persons alter the offence accordingly in accordance with law.

5.With the above direction, this Criminal Original Petition is Disposed of.
