The prayer of the petitioner is for a mandamus directing the Assistant Director, Department of Ex-Servicemen Welfare Office/ R1 to consider his representation dated 03.04.2023 seeking enquiry into the genuineness of documents registered and certificates obtained by his father in favour of R2 and R3.

2. Even though counter affidavits have been filed by R1 as well as by R2, it is the say of learned Government Advocate that there has been no response to the notice that has been issued to the petitioner and it is for this reason, enquiry could not be proceeded with. The respondents are also inclined to dispose the matter expeditiously.

3. Let the petitioner as well as private respondents appear before R1 on Monday i.e., 15.07.2024 at 12 noon without anticipating any further notice in this regard. R2 and R3 shall serve a copy of the counter filed by them to the petitioner prior thereof in order that the petitioner is apprised of their stand.

4. R1 shall hear the parties, consider documents, if any, filed by them and pass orders on the petitioner's representation dated 03.04.2023 in accordance with law and all extant rules and regulations within a period of eight (8) weeks from date of receipt of a copy of this order. 2/4
