ORDER

This petition has been filed seeking a direction to the Judicial Magistrate No.VI, Coimbatore, to expedite the case in CC No.2864 of 2019 filed under Sections 294, 323, 506(ii) of IPC.

2. It is the contention of the learned counsel for the petitioner that from the year 2020 onwards, summons have not been served on the accused and no attempt whatsoever has been made by the respondent police to serve the summons. To substantiate his submission, he has also placed the notes paper of the Trial Court.

3. Heard the learned Government Advocate (Crl. Side) and perused the materials available on records carefully.

4. On perusal of the records, it is evident that the summons have not been served on the accused from 25.02.2020 onwards. Continuously, the matter has been adjourned without taking any effective steps. 2/4

5. In such view of the matter, the learned Judicial Magistrate No.VI, Coimbatore, is directed to issue necessary instructions to the concerned Inspector of Police for service of summons. The learned Government Advocate (Crl.Side) is also directed to instruct the respondent police to serve the summons on the accused as expeditiously as possible. After the appearance of the accused before the concerned court, the Trial court shall expedite the hearing and dispose of the C.C.No.2864 of 2019 as expeditiously as possible.

6. With the above directions, this Criminal Original Petition is disposed of. No costs.
