Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the entire records relating to the order dated 13.09.2023 in RFL/2 No joint Sub Registrar Dharmapuri/145/2023 by the second respondent to register the settlement deed dated 13.09.2023 presented for registration by the petitioners and return the same to the petitioners.

O R D E R

This Writ Petition has been filed for issuance a Writ of Certiorarified Mandamus, to call for the records relating to the order dated 13.09.2023 passed in RFL/2 No. Joint Sub Registrar Dharmapuri/145/2023 by the second respondent and direct the second respondent to register the petitioners' settlement deed.

2. Learned counsel for the petitioners submitted that since the petitioners have not produced original parent document for comparison, the second respondent refused to register the settlement deed.

3. Heard the learned counsel for the petitioners and the learned Special Government Pleader appearing for the official respondents and perused the materials available on record.

4. Though Rules have been struck down, still the Officers insisted the petitioners to file the original documents. Despite certified copies have been filed by the petitioners, the respondents refused to register the settlement deed. The respondents are directed to consider the petitioners' representation and pass orders in accordance with law.

5. With the abovesaid direction, the Writ Petition is allowed. There shall be no order as to costs. Consequently, connected miscellaneous petition in W.M.P.No.27924 of 2023 is ordered on payment of necessary Court fees by each of the petitioners.
