PRAYER : Criminal Original Petition has been filed under section 482 of Criminal Procedure Code, to direct the respondent to conduct the investigation in Crime No.122 of 2023 on the file of respondent as expeditiously and to file the charge sheet before the concerned Magistrate within the period to be stipulated by this Court.

ORDER

The petition to expedite the investigation in Crime No.122 of 2023 on the file of the Elavanayurkottai Police Station, Kallakurichi District is on the premise that the complaint registered on 20.04.2023 for the alleged offence Page No.1/4

under Sections 406, 420, 294(b) and 506(i) of IPC against one Britto and Irudhayaraj has not taken up for investigation by the respondent Police.

2. The learned Government Advocate (Crl.Side) representing for the State, on instructions, submitted that since the alleged cheating is to a tune of Rs.44 lakhs, as per the manual of the District Police, offence above Rs.25 lakhs has to be investigated by the District Crime Branch and therefore, Elavanayurkottai Police had transferred the matter to District Crime Branch for investigation. The learned Government Advocate also submitted that the investigation will be completed within a period of five months and final report will be filed.

3. The above submission is recorded and the petition is disposed of with a direction to District Crime Branch, Kallakurichi District to complete the investigation and file a final report within a period of five months. 03.10.2023 Internet : Yes/No Index : Yes/No rkp Page No.2/4
