The prayer in the criminal original petition is to register a first information report as per the order passed in Crl.M.P.No.1254 of 2025 dated 08.08.2024.

On a perusal of the said order that is passed by the learned Judicial Magistrate No.II, Jayankondam, it can be seen that the learned Magistrate has also directed to conduct a preliminary enquiry and thereafter to register the First Information Report. In this case, it is the contention of the respondent police that on the preliminary enquiry they found that the matter is civil in nature and accordingly a report is also filed before the learned Magistrate. In view thereof the prayer as such made in this petition cannot be countenanced and accordingly this Criminal Original petition is disposed of with liberty to agitate the remedy before the concerned magistrate.
