PRAYER: Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, praying to direct the second respondent to register the complaint dated 18.02.2022 in accordance with law. This Criminal Original Petition has been filed to direct the second respondent police to register a case based on the petitioners' complaint dated 18.02.2022.

Heard the learned counsel for the petitioners and the learned Government Advocate (Crl. Side) appearing for the respondents 1 and 2.

The learned counsel for the petitioners submitted that the third respondent was the erstwhile counsel, who acted as petitioners' counsel in a matter relating to the partition between themselves and respondents 4 to 8. During the course of the said transaction, the third 2/6

respondent obtained signatures of the petitioners and started to act against their interest; the third respondent had also executed a document in favour of the third parties in respect of the property belonging to the petitioners without their consent. With these allegations and other allegations, the petitioners had given a complaint to the first respondent police but so far no action has been taken.

The learned Government Advocate (Crl. Side) appearing for the respondents 1 and 2 submitted that on the complaint given by the petitioners, current paper enquiry has been initiated in C.S.R.No.2 of 2022 and enquiry is under progress. It is further submitted that the third respondent in his capacity as the advocate of the petitioners had retained the documents of the petitioners and he would return them if the petitioners do not continue to engage the service of the third respondent. 5.

Since the enquiry in this matter is still pending, I feel it is appropriate to direct the second respondent police to complete the enquiry 3/6

in C.S.R.No.2 of 2022 and do the needful in accordance with law within a period of two weeks from the date of receipt of a copy of this order. 6.

With these observations, this Criminal Original Petition stands disposed of.
