ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 126(2), 109(1) of BNS in Crime No.129 of 2025, registered on the file of the respondent police, seeks anticipatory bail.

The case of the prosecution is that on account of previous enmity between A1 and the defacto complainant, the petitioner along with other accused brutally attacked the defacto complainant using knife; that thereby the defacto complainant sustained grievous injuries. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner and the defacto complainant belongs to same locality and at the time of occurrence, there was a wordy quarrel arose and both parties attacked each other. He further submitted that the petitioner has been falsely implicated in this case and he is ready to abide by any condition that may be imposed by this Court and sought for anticipatory bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submits that the defacto complainant was seriously injured and discharged from the hospital; that the petitioner has five previous cases of similar nature; and that the investigation is pending.

Considering the facts and circumstances of the case, the grave nature of offence, the previous antecedents of the petitioner, the investigation of this case is pending and taking note of the fact that granting of anticipatory bail may encourage the petitioner in committing similar offence, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.

Accordingly, this criminal original petition stands dismissed. 07.10.2025 stn 3/4
