Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition Nos. 24 (ii) and (iii) imposed in the anticipatory bail order dated 12.09.2019 made in Crl.OP.No.19550 of 2019.
Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.N.MANOHARAN Advocate for the petitioner and of MR.R.PRATHAP KUMAR Government Advocate and of MR.A.ILAYA PERUMAL Advocate for Intervener, on behalf of the Respondent the court made the following order:- [Order of the Court was made by M.SATHYANARAYANAN, J.,] The petitioner is arrayed as A-5 and vide order dated 12.09.2019 made in Crl.O.P.No.19550 of 2019, he was enlarged on bail, subject to certain conditions and one of the conditions is that he shall stay at Kancheepuram District and report before the Inspector of Police, Siva Kanchi Police Station, at 11.00 am until further orders, except on the dates where he is required to be present before the respondent / Investigating Agency for the purpose of Investigation.
2. Mr.N.Manohar, learned counsel would submit that the petitioner has scrupulously complied with the conditions from 20.09.2019 onwards except on the hearing dates before the Bar Council of Tamil Nadu.
3. The learned Additional Public Prosecutor on instructions would submit that the petitioner is complying with the conditions.
4. The learned counsel for intervenor / defacto complainant would submit that the petitioner is yet to handover the office copies of the documents pertaining to the Execution Petition filed in respect of fake arbitral award and in response to the same, the learned counsel for the petitioner undertakes to submit the same before the Investigation Officer.
5. In the light of the above facts and circumstances, condition Nos.2 and 3 enforcing the order dated 12.09.2019 are relaxed and the petitioner shall appear before the respondent Police, once in a week on Thursdays at 11.00 a.m. for a period of four weeks and thereafter as and when required before the respondent Police.
6. The Criminal miscellaneous petition is disposed of accordingly.
