Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for the issue of Writ of Mandamus, directing the respondents to declare the Medical seat to MBBS course in Government Theni Medical College is vacant consequent to the discontinuance of study by the candidate K.V.Udit Surya and to consider the petitioner for admission into Medical seat in operation of wait list for the academic session 2019-2020.

O R D E R

This petitioner when approached this Court earlier under W.P.No.28201 of 2019 with prayer akin in this writ petition, this Court dismissed the writ petition on two grounds namely the petition is pre matured and the date for admission fixed by the Hon'ble Supreme Court has expired as early as 30.08.2019 and the prayer was also considered as pre matured. The said reason still holds good in this writ petition also. In addition. the person whose seat alleged to be declared vacant is not arrayed as a respondent in this writ petition and behind his back no order can be passed.

2. In the result, the writ petition is dismissed. Consequently, the connected miscellaneous petition is closed. No costs.
