This petition has been filed under Section 34 of the Arbitration and Conciliation Act, 1996 (for brevity hereinafter referred to as "the Act"), challenging the Award passed by the Arbitral Tribunal dated 22.08.2023, which was modified by the subsequent order dated 02.09.2023. 2.The parties decided to resolve the dispute amicably between themselves. Accordingly, a joint memo of compromise has been filed by the petitioner and the respondent and the same has been signed by the parties and their respective counsel. The petitioner is represented through power of attorney agent and a copy of the Power of Attorney dated 12.09.2025 was also placed before this Court and the same is taken on record. The parties were also present at the time of hearing and a demand draft for a sum of Rs.35lakhs was handed over by the learned counsel for the petitioner to the learned counsel for the respondent.
3.In the light of the above development, the award passed by the sole arbitrator dated 22.08.2023 and as modified by order dated 02.09.2023, is hereby set aside and this petition is disposed of in terms of the joint memo of compromise dated 09.01.2026. Connected application is closed. 2/4
4.In view of this development, the petitioner will be entitled for refund of the court fees.
