ORDER

This petition has been filed to set aside the order of dismissal for non-prosecution dated 24.03.2023 passed in C.M.A.No.414 of 2018 and to restore the above appeal.

2. Heard the learned counsel appearing on behalf of the petitioner and the learned counsel appearing for the second respondent. R1 remaind ex-parte before the Tribunal.

3. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this Court is inclined to order this petition.

4. Accordingly this petition is allowed.
