Respondent(s) PRAYER Writ petition filed under Article 226 of Constitution of India for the issuance of writ of Mandamus directing the 6th respondent to reimburse a sum of Rs. 5,72, 340/-(Rupees five lakhs seventy two thousand three hundred and forty only) incurred towards the treatment and surgery of petitioner late father based on the proceedings of the 4th respondent dated 08.08.2024 along with interest at the rate of 12 percentage per annum for the delayed payment and pass orders.

ORDER

This writ petition has been filed for the issue of writ of Mandamus directing the 6th respondent to reimburse the sum of Rs.5,72,340/- incurred for the treatment towards the surgery of the

petitioner's late father based on the proceedings of the 4th respondent dated 08.08.2024 along with interest for the delayed period 2.

Heard Mr.K.Sathish Kumar,learned counsel for the petitioner and Mr.P.Ganesan, learned Additional Government Pleader for Respondents 1 to 5 and Mr.Adi Veera Rama Pandian, learned counsel for 6th respondent.

The case of the petitioner is that his father was a member of Tamil Nadu Medical Health Scheme and Contribution was made by monthly deductions from his pension. The petitioner's father underwent treatment and as a result, a sum of Rs.5,72,340/- was incurred. The application was forwarded by the 5th respondent to the 4th respondent through letter dated 18.07.2024. The 4th respondent after considering the claim recommended for the reimbursement of the said amount from the 6th respondent, which is the insurance company. The grievance of the petitioner is that the 6th respondent did not act upon the proceedings of the 4th respondent and hence, the present writ petition has been filed seeking for appropriate directions.

Taking into consideration the facts and circumstances of the case and also considering the fact that the 5th respondent had sought for the approval of the 4th respondent and the 4th respondent has recommended for the reimbursement of the amount, there shall be a direction to the 6th respondent to act upon the proceedings of the 4th respondent dated 08.08.2024 and shall reimburse the insurance amount to the petitioner within a period of four weeks from the date of receipt of a copy of this order. It is made clear that if the amount is not reimbursed within the time frame fixed by this Court, the said amount shall be paid with interest at the rate of 7.5% per annum from the date the amount become payable till the actual date of realization.

This writ petition is disposed of with the above directions. No costs.
