ORDER

(Order of the Court was made by R.Suresh Kumar J.) This civil miscellaneous petition has been filed to condone the delay of 683 days in filing the above writ appeal.

2. Heard Mrs.E.Ranganayaki, learned Additional Government Pleader appearing for the petitioners / appellants.

3. In the affidavit filed in support of the petition, administrative reasons have been stated. Though it has been critisized and questioned by Mr.A.R.Nixon, learned counsel for the sole respondent, who also filed a counter, we feel that if the condone delay petition is rejected at this stage, the rights of the parties on the merits of the case to be agitated in the main appeal would get defeated.

4. In that view of the matter, we are inclined to allow this petition. Accordingly, this petition is ordered and the delay is condoned on payment of costs of Rs.5,000/- (Rupees Five Thousand only) to the respondent, to be paid by the appellants through the learned counsel for the respondent within a period of two weeks from the date of receipt of a copy of the order.

5. On such payment of costs, Registry is directed to number the appeal and place the same for admission, if the papers are otherwise in order.
