ORDER
The present writ petition has been filed praying for a writ of Mandamus to direct respondent to select the petitioner to the post of Post Graduate Assistant in Geography pursuant to Notification No. 01/2021 dated 9.09.2021 under the turn Most Backward Class/ De- Notified Community- Most Backward Class and De- Notified Communities in the welfare Department (MBC/DNCMDWD).
2. It is submitted that petitioner secured 79 marks out of 150 in the computer based written exam and was included in the Provisional selection list dated 13.10.2022 as eligible for the post of PG Assistant in Geography under the turn Most Backward Class/ De- Notified Community- Most Backward Class and De- Notified Communities in the welfare Department (MBC/ DNCMDWD) MBC/ DNC- MDWD.
3. There is discrepancy between entries in the 1st provisional list and the 2nd provisional list with regard to the category of reservation under which
petitioner is covered inasmuch as initially the petitioner was shown under the category MBC-DNC T and later under the category MBC/DNC-MDWD.
4. After submitting for a brief while, learned counsel for petitioner sought leave of this Court to file a fresh representation in this regard and would request that the same may be considered in accordance with law, which was agreed to by the learned counsel for respondents.
5. Learned counsel for respondents would submit that if such representation is made by the petitioner, the same would be considered and appropriate orders would be passed regarding the petitioner's request.
6. In view of the above, it is open to the petitioner to submit a representation to the respondents within a period of two weeks from the date of receipt of a copy of this order. If any such representation is submitted by the petitioner within the stipulated time, the same shall be considered by the appropriate authority and orders shall be passed within a period of four weeks thereafter, after affording reasonable opportunity of hearing to the petitioner and other interested parties, if any, in accordance with law.
7. The writ petition stands disposed of with the above directions. No costs.
