ORDER
This writ petition has been filed seeking issuance of a writ of mandamus directing the first respondent to act upon the application submitted by the petitioner wherein the petitioner is seeking for renewal/re-issuance of passport.
2. Heard Mr.V.Gunasekar, learned counsel for petitioner, Mr.S.Dilliraj, learned Central Government Standing Counsel appearing for first respondent and Mr.V.Meganathan, learned Government Advocate [Crl.side] appearing for second respondent.
3. Learned Government Advocate [Crl.side] appearing for the second respondent, on instructions, submitted that a case is pending against the petitioner in S.C.No.78 of 2016 on the file of the Sessions Judge, Special Court for Exclusive Trial of SC/ST (POA) Act Cases, Villupuram.
4. Learned counsel for petitioner submitted that the petitioner is presently working in UAE and his passport expired on 24.02.2025. He has 2/4
applied for renewal of passport before the Consulate General at UAE and it is pending. Learned counsel also brought to the notice of this Court the order passed in Crl.O.P.No.21057 of 2023 dated 25.09.2023. The relevant portion is extracted hereunder:
"3. The case was split up and A1 faced trial before the Special Court in Spl.S.C.No.247 of 2015 and through judgment dated 11.01.2017, A1 was acquitted from all charges. The split up case in S.C.No.78 of 2016 is now pending against the petitioner (A3). The judgment that was passed for A1 will also enure to the benefit of the petitioner (A3). Hence, there shall be a stay of proceedings in S.C.No.78 of 2016, pending disposal of the criminal original petition."
5. It is clear from the above that criminal proceedings against the petitioner has been stayed by this Court. Hence, there shall be a direction to the first respondent to inform about this order to the Consulate General of India, Dubai and the application submitted by the petitioner shall be acted upon and his passport shall be renewed for the regular period. This process shall be completed within a period of four (4) weeks from the date of receipt of a copy of this order.
