Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus to direct the third respondent to provide police protection to the petitioner to construct a compound wall in his property situated in Thottipalayam Village No.14, T.S.Ward No.2, comprised in Survey No.506, 507, Old T.S.No.14/8, 14/9 and 14/10, New T.S.Nos.9 & 10, Block No.89 bearing Plot No.21, measuring an extent of 2632 sq.ft., V.O.C.Nagar Extension, Old Ward-7, New Ward-18, Tiruppur Municipal Division by considering the petitioner's representations dated 21.08.2024 by appreciating the above stated facts.

O R D E R

This petition has been filed seeking direction to the third respondent police to give police protection to the petitioner for constructing a compound wall in his property situated in Thottipalayam Village by considering the petitioner's representations dated 21.08.2024. According to petitioner, the fourth respondent being a ward councilor, has trespassed into the petitioner's property and obstructed the petitioner from putting up the compound wall around his property. Further the fourth respondent also threatened the petitioner with dire consequences by engaging some hooligans.

From the materials, it is seen that the petitioner filed civil suit against the fourth respondent in O.S.No.99 of 2024 for permanent injunction, which is pending before the Civil Court. Therefore this Court is not inclined to 2/4

give any direction as sought for by the petitioner. However, the petitioner is liberty to workout his remedy before the Civil Court, where the suit is pending.
