This writ petition has been filed challenging the suspension order passed by the 2nd respondent dated 10.02.2023 and for a consequential direction to the respondents to reinstate the petitioner into service. 2.

Heard Mr.M.Sasi Kumar, learned counsel for the petitioner and Mr.P.Harish, learned Government Advocate for respondents 1 and 2. 3.

The case of the petitioner is that he was working as a Sub Registrar Grade I at Thalaivasal, Salem District. An FIR came to be registered in Crime No.1 of 2023 by the Inspector of Police, Vigilance and Anti-corruption, Salem. The petitioner was arrayed as an accused in this case. In view of the same, the order of suspension came to be passed by the 2nd respondent through proceedings dated 10.02.2023. The same has been put to challenge in the present writ petition.

On carefully considering the submissions made on either side and the materials placed before this Court, it will suffice if a direction is given to the 2nd respondent to consider the representation made by the petitioner on 25.10.2023 wherein the petitioner had sought for the revocation of the suspension order and for reinstatement into service. The suspension of the petitioner has continued for more than 1 1⁄2 years without the same being reviewed. Therefore, the representation made by the petitioner has to be necessarily considered by the 2nd respondent. 5.

In the light of the above discussion, there shall be a direction to the 2nd respondent to deal with the representation made by the petitioner on 25.10.2023 on its own merits and in accordance with aw and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order.

The petitioner is directed to make a fresh representation to the 2nd respondent along with all the relevant documents and also a copy of this order. 3/5
