Respondent PRAYER: Criminal Miscellaneous Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, to relax the condition that the petitioner shall appear before the trial court on the first working day of every month at 10.30 am until the disposal of the appeal and if he is not able to appear before the trial court on any day, he shall make arrangements to file an application under Section 317 Cr.P.C and shall appear before the trial further orders and he shall appear before the trial court on any other day in lieu of the date of their absence, as directed by the trial court imposed in Crl.M.P.No.14329/2024 in Crl.A.No.1283/2024.

ORDER

The condition imposed by the Court while granting suspension of sentence on 27.11.2024 in Crl.M.P.No.14329 of 2024 in Crl.A.No. 1283 of 2024 is sought to be relaxed.

2.The learned counsel appearing for the petitioner submitted that she is working in a private concern and having one year old child. Hence, she prayed to relax the condition.

3. Considering the above, the condition is relaxed and the petition is ordered accordingly. The petitioner shall appear before the trial court once in two months at 10.30 am until the disposal of the appeal. 08.09.2025 Index : Yes/No : Yes/No Speaking/non-speaking order rpl To 2/4
