JUDGMENT

This Civil Miscellaneous Second Appeal has been filed against the judgment and decree dated 02.07.2019 in CMA.No.187/2016 on the file of the Principal District Judge, Namakkal, reversing the fair and decreetal order dated 10.12.2013 in HMOP.No.93 of 2011 on the file of the Subordinate Judge, Tiruchengode.

When the matter was called, the learned Counsel for the appellant submitted that he has got written instructions from the appellant not to press this appeal. Therefore, he seeks permission of this Court to withdraw the present appeal. He has also filed a Memo along with the written instruction of the appellant to that effect.

Recording the same, permission is granted to withdraw the appeal. Accordingly, the Civil Miscellaneous Second is dismissed as withdrawn. No costs.
